its a minefield but remember all the stories of abuse in homes
this is because their is no legislation surrounding the care
of the elderly
the adults with incapacity 2000 act is a contradiction in terms
you see if you can sign for a power of attorney you don't
need one, don't get caught up in it
i know from experience. its costly

there is a statute of limitations in most places stating the house must be signed over a certain number of years before going into a home, so she should do this, reserving life's use (which does not include "assisted living", a friend of mine got screwed over and out of his home by his step-daughters who couldn't wait for him to die after a slight stroke). You have to understand the attitude of government is that those people who worked and saved all their lives should not be able to pass this wealth to the next generation, it should be seized and sold by the government and distributed amongst various government agencies and handed out to people who do nothing but make more demands and vote for the leftwing agenda. And this is how you cleanse rural, suburban or urban areas of the farmers and working poor people for exploitation by wealthy developers and bureaucrats.

Faceless government piranhas are probably trying to trace her at this very moment to squeeze every penny from her savings as well as take her house. In the wonderful world of hindsight she should have become an MP in her earlier years and then she would have owned at least five houses now.

Prawn this is always a sad time in anyones life i feel for you!! now your in a unique situation regarding your sister which should stop authorities make you dispose of the house!!Now if Mum was paying to go to a home the question wouldn't arise but in your case its relevant so i suggest you call into the CAB in the first instance and they cant advise you then if you can afford it consult a solicitor//My own belief the odds are are on Mums side Good Luck Lovey

it sounds like your mom wants to stay in her own home and is just depressed over the whole situation . I`m in that position myself . 15 years ago my mother had a severe stroke and was about to lose her home and be put into a home . she got very depressed and started having small strokes due to the stress . at that point I took control of her health by power of attorney and then let her move in with me to keep an eye on her . best thing I could have done for her and myself . she came around and started smiling more and feeling good about herself because she was no longer alone and with someone who loves her and cares about her . my mother is 82Yrs old now and bowls every week ,goes for walks all by her self and love to walk to the beach twice a week . love will bring her around and it`s your turn .your mother gave up a lot for you when you where a child and now it`s up to you to give back the love that she so freely gave to you .

If she lived alone, there is no question that she would have to sell the house, however as your sister is living there things are a bit more compliated. Is your sisters name on the mortgage or deeds to the house ? if she has an endowment for the conversion, this makes this part of the house hers ? This is really complicated and the best thing you can do is go and see citizens advice bureau, they really are very helpful, and if they dont know the answers themselves they will put you in touch with someone who does. good luck

Your best thing to do is seek advice from her social worker. If your sister lives in your mothers home it gives the situation a different perspective.
